Severe drought conditions through much of the state prompted Missouri DOT (MoDOT) to offer a special overwidth hauling permit to help farmers and ranchers move hay. Fee for permit was waived until March 1, 2023.

Q3.1 Please share other innovations or lessons learned from past emergency overweight permitting or waiver events are their other innovations or lessons.
Montana standardized language for the emergency declaration. The benefit is that the language is the same irrespective of the type of emergency.
I would say to remove policy and procedures from regulations, this gives our office the latitude to make changes in procedures vs needing gov approval, i.e., meaning can be dealt with at Secretary or Administrator levels.
Also include industry in the decision making, listen to their needs and challenges.

Current status of potential legislation as of 3/27/23.
  • The work this group did to create a multi-state standardized approach to divisible overweight loads during a declared emergency is extremely valuable.
  • Because the midwestern states in this group agree, shippers will know in advance that during an emergency, they can confidently move a load of 88,000 lb. gross weight across member states.
  • The agreement ONLY APPLIES IN A DECLARED EMERGENCY – when the conditions of the Stafford Act are met.
  • At any time other than a Stafford Act emergency, any load that can be reduced (partially unloaded) to meet weight limits, must be reduced. Overweight permits are available for unreducible loads ONLY.

When confronted with an emergency or disaster, it’s best to begin outreach with impacted stakeholders and partner agencies and the Governor’s Office as soon as possible.
Q 4.1 Please share how your state was affected/impacted by emergency special permits or waivers that were issued for commercial vehicles in another state?
During Covid we were allowed to haul heavier weights on the interstate for divisible loads. We have worked in the past during national emergencies moving FEMA trailers in and out for people to live in. During droughts we have allowed hay movements through our state for hay, feed for cattle or moving cattle to other locations that weren’t drought stricken.
Other jurisdictional waivers are accepted and recognized by roadside enforcement and/or inspectors.
No harmonization within regions.
Some drivers who were given an exemption in one state EXPECT that exemption to carry over to every state. The drivers don’t understand the difference between federally exempted rules and state exempted rules. This leads to many of these drivers not following the rules, sometimes trying to coerce authorities from other states to allow them to go even though they are rules that state has not implemented, sometimes deliberately, and sometimes due to lack of understanding. This can create hostile environments between drivers and agents.
Regional disasters result in emergency waivers in surrounding states. We honor those waivers.

Requests from movers to provide an emergency declaration in our state to move items to other states. This must be approved by the governor’s office.
Weights were not harmonized from state to state for emergency relief.
One example of how our state was impacted by waivers issued in another state was in 2014 when the MN Cattlemen’s Association requested that our Governor issue an EEO waiver to provide relief to carriers traveling from Minnesota to aid in emergency relief efforts in the southern plain states which were suffering from wildfires.
