APPENDIX B

Example Technical and Price Proposal Requirements

For both qualifications-based selection (QBS) and best value procurements, proposal requirements and evaluation criteria should be carefully tailored to project-specific needs and goals. The intent is to provide for a meaningful evaluation of proposers without being overly burdensome. Typical proposal requirements address

  • The proposed organization chart for the team (e.g., proposed firms to perform architectural design, structural engineering, mechanical engineering, electrical engineering, fire protection engineering, cost estimating, scheduling, demolition, construction, materials testing),
  • Team’s history of working together,
  • Team’s project experience on comparable projects using the delivery method in question,
  • Experience of key personnel [e.g., project director, design project manager, lead design personnel in specific disciplines, building information modeling (BIM) manager, preconstruction manager, construction manager, lead superintendent; lead cost estimator, quality control manager, safety manager],
  • Project-specific management plans (e.g., safety, quality, stakeholder engagement) that demonstrate understanding of project-specific risks and issues and identification of viable mitigation strategies (as opposed to company boilerplate plans),
  • Constructability and phasing plans, and
  • Design approaches and concepts [for design–build (DB) and progressive design–build (PDB)].

By way of example, the following is an exhibit that was included in Nashville International Airport’s request for proposal (RFP) for its Concourse D and Terminal Wings PDB project. The extract sets forth Nashville’s requirements for both technical proposals and price proposals.


The Proposer must address all Mandatory Requirements & Information items and provide, in sequence, the information and documentation as required. The MNAA [Metropolitan Nashville Airport Authority] will review all general mandatory requirements & information items, including, but not limited to the following:

  • Proposal received on or before the Proposal Deadline.

  • Technical Proposal contains no cost data.
  • Proposer did not submit alternate proposals.
  • Proposer did not submit multiple proposals in a different form.

Technical Proposal does not contain any restrictions of the rights of the MNAA or other qualification of the proposal.

SECTION A—MANDATORY REQUIREMENTS

A1. Provide a copy of State of Tennessee Contractors License, a copy of State of Tennessee Architectural/Engineering License, signed Drug Free Workplace Affidavit (Appendix “E”), Non-Collusion Affidavit (Appendix “F”), Certificate of Acknowledgement (Exhibit “G”) and Affidavit of Debarment (Appendix “H”).

A2. Exceptions to the draft design–build contract included in the RFP must be noted in Respondent’s proposal. Exceptions taken after the award may result in the withdrawal of the intent to award. Any listing of exceptions by a Respondent in their proposal in no way obligates MNAA to change the contract’s general terms and conditions, the requirements of the RFP, or the insurance requirements of this solicitation. If exceptions are taken, evaluation scores will reflect MNAA’s assessment of the impact for these considerations; those exceptions may result in the rejection the proposal as nonresponsive, if, in the sole evaluation of MNAA, the requested changes are unacceptable.

A3. Provide a statement on the Respondent’s experience at providing Progressive Design–Build (PD/B) services (design and construction phase services) or Design–Build (D/B) services. A Respondent, to be considered, must have a minimum of ten (10) years of experience as a PD/B or D/B in providing the services outlined in the Scope of Services Section. If a Respondent is a joint venture firm, at least one joints venture party must have a minimum of ten (10) years of said experience and other joint venture party or parties must have a minimum of five (5) years of said experience. If a joint venture, provide a history of this joint venture relationship.

A4. Provide at least two (2) or more of the most recent years of financial statements, consisting of at least a balance sheet and income statement. Internally prepared financial statements may be submitted, but should be prepared in accordance with generally accepted accounting principles (GAAP). The MNAA, at its sole discretion, may require the Respondent provide additional financial information, to include a compilation, audit or review of the financial statements from an independent certified public accountant (CPA) prior to the final award of the contract. If the requested financial information does not support the financial stability of the Respondent, the MNAA reserves the right to reject the Proposal.*

A5. Provide a statement of whether the Respondent or any individual who shall perform work under the contract has a possible conflict of interest and, if so, the nature of that conflict.

A6. Describe the Respondent’s form of business (i.e., individual, sole proprietor, corporation, non-profit corporation, partnership, limited-liability company) and detail the name,

mailing address, telephone number, and e-mail address of the person the MNAA should contact regarding the proposal.

A7. Provide a statement of whether there have been any mergers, acquisitions, or sales of the Respondent company within the last five (5) years, and if so, an explanation providing relevant details.

A8. Provide a statement of whether the Respondent or any of the Respondent’s employees, have been convicted of, pled guilty to, or pled nolo contendere to any felony, and if so, an explanation providing relevant details.

A9. Describe the Respondent organization’s number of employees, type of client base, and location of offices.

A10. Provide annual dollar workload volume inclusive of number of projects on a per year basis for the last five (5) years and indicate what percentage of such work are Design–Build services.

A11. Must meet or exceed MBE [minority business enterprise] and WBE [women’s business enterprise] participation level or provide acceptable good faith effort to meet the MWBE [minority- and women-owned business enterprise] participation level or the response. The attainment of the level established for this Project is to be measured as a percentage of the total dollar value of the Project. The MBE and WBE participation level for this Project is as follows: 6.29% MBE and 9.13% WBE. Failure to meet the participation level or provide acceptable good faith efforts to meet the participation may result in the response being deemed nonresponsive.

SECTION B—TEAM/INDIVIDUAL QUALIFICATIONS, EXPERIENCE

B1. Organization and Personnel—provide the following:

  1. Organizational chart for the team proposed for this project. Identify which firm each of key personnel work for.
  2. Include the resumes of key personnel who shall be assigned by the Respondent to perform duties or services under the Contract. The resumes shall detail each individual’s title, education, current position with the Respondent, employment history, and experience highlighting projects of similar scope and complexity that are under construction or have been substantially completed or completed. Personnel shall include, but not limited to: the project manager (for design and construction, if different), key design personnel, pre-construction manager, lead superintendent; lead cost estimator; quality control manager; independent safety manager and other key personnel who may be required. A project executive (by whatever name called) must also be named in key personnel but not be exclusively assigned to this Project. The key personnel must be considered in light of the complexities of phasing construction, systems and special systems in and around an operating airport.
  3. Provide a cost loaded management and staffing plan on the form provided, (Exhibit “Q” Resource Loaded Staffing Form). List the proposed design and construction

  1. management office staff. If the entire staff are not known, list the positions and titles required. The staffing plan must be comprehensive in order to capture the total management staff hours. Personnel should include the field office project management staff through to the level of lead project superintendent, including, but not limited to: project managers, administrative staff, office engineers, estimators, and other construction site office staff and office design positions. Use a fully burdened labor charge rate. The labor burden must include payroll burden only to compute the labor component of the Pre-Construction Services and Construction Phase, Construction Management Cost for CGMP1 [Component Guaranteed Maximum Price 1]. Complete the tabulation of all non-labor costs provided at the bottom of Exhibit “Q” Resource Loaded Staffing Form. The expenses may include cost for such items as, telephones, vehicles and transportation cost; reimbursable costs, other general expenses, overhead and fees (for Pre-Construction only).
  2. A listing of all consultants required to complete the Work. Include the hours and rates for their services. Provide an explanation on how and these resources bring value to the project.
  3. Identify and include, (as described in “c” above), key design assist subcontractors as part of Preconstruction phase and describe how these bring value to the project. Provide an explanation on how and these resources bring value to the project.

B2. Past Experience—Provide the following:

  1. A list of the top three (3) current airport projects on which your firm is committed, the dollar volume and time frame for each, and what services are being provided (i.e., PD/B, D/B, CM [Construction Manager] at Risk, GC [General Contractor], designs, etc.), as well as the total dollar value each firm currently has committed.
  2. A list of all contracts with the MNAA, current and all those completed within the previous five (5) year period.
  3. A list of all claims, litigation, arbitrations or mediations the Proposer has had with an Owner in the last five (5) year period. Identify the type of dispute (e.g. claim, litigation, etc.), the Owner, nature of the dispute and the resolution of the dispute.

SECTION C—TECHNICAL APPROACH

C1. Provide a description of how the Respondent intends to address all major disciplines, including, but not limited to, the following: civil, architectural, structural, mechanical, electrical, communications, baggage handling, special systems, flight information displays, electronic information display for design & construction phase services.

C2. Describe your approach to design assist process including specifically what disciplines and trades you will use in this process and at what stages you intend to procure the services. How will a competitive bidding environment be maintained with the subcontract and supplier market?

C3. Provide a brief description of how the Respondent intends to address day to day operations: maintaining, safety, unimpeded operations, aesthetics, environmental integrity for: vehicular and pedestrian traffic of airport, airlines and airport tenants.

C4. Provide a description of how the Respondent intends to meet time and budget requirements. Describe your approach to the design to budget requirement. Submit a detailed Design to Budget Plan and Approach to control the progressive GMP [Guaranteed Maximum Price] and final GMP to maintain the budget. Explain how to maintain the integrity of the design intent throughout the progressive design–build process in order to avoid a re-design.

C5. Provide a conceptual schedule showing at minimum: procurement, design, preconstruction, and construction phases. Include the major CGMP milestones and provide the final GMP milestone in accordance with Exhibit A. Indicate other milestones in accordance with Exhibit A. At a minimum show, all major milestones including design completion, first work package, and CGMPs. Resource staffing plan as described in Cost breakdown detail shall coincide with the Respondent’s conceptual schedule and align with the design to budget GMP plan and as required by Contract.

C6. Provide a description of the Respondent’s company specific safety program, how long it has been in-place and safety record including, but not limited to the following:

  1. If the previous 3 years OSHA [Occupational Safety and Health Administration] has cited this Firm for “Willful Violation.”
  2. OSHA Recordable Incident rate for the last 3 years.
  3. OSHA Lost Days Away Incidence Rate for the last 3 years.
  4. Experience Modification Rating for the past 5 years.
  5. Log and summary of Occupational Injuries and Illnesses as required by the U.S. Department of Labor for the past 12 months (OSHA Form No. 300)

C7. Provide a description of the Respondents company specific Quality Control program.

C8. Describe approach to attain LEED [Leadership in Energy and Environmental Design] Silver ‘Desired’ status and Total Cost of Ownership, (TCO) in the design and construction of key systems.

C9. Provide the outline of your business community outreach plan in order to provide for the best possible participation and competitive pricing and high-quality resources for this project. Explain how it is determined when the resources are required.

C10. Provide an option to subcontractor default insurance for the project. Such option should outline cost, limits, retention, and criteria for subcontractor inclusion.

SECTION D—SMWBE PARTICIPATION AND WORKFORCE DEVELOPMENT

The Respondent must address all SMWBE [small, minority, and women-owned business enterprise] section items and provide, in sequence, the information and documentation as required (referenced with the associated item references).

D1. Addressing the following regarding SMWBE participation: *

  • Describe in detail your firm’s internal procedures, programs or policies designed to foster commerce with DBE/SMWBE firms. You may include a copy of your firm’s program if applicable. PLEASE DO NOT INCLUDE INFORMATION ABOUT YOUR FIRM’S EQUAL EMPLOYMENT OPPORTUNITY (EEO) POLICY.
  • Provide a detailed plan of your firm’s SMWBE participation for this project, including the firm’s name, roles and responsibilities, percentage of participation, and certification classification. If your firm is not able to meet the participation level, please provide the Good Faith Effort (GFE) information referenced in this solicitation.
  • Provide a list of at least three (3) projects over the last 24 months in which your firm partnered with or subcontracted work to a SMWBE firm. Please include the project name, contract information, SMWBE firms utilized (including their contact information) and the participation percentage required and the participation percentage your firm achieved.

D2. Provide a workforce development plan which includes but is not limited to the following: Promise Zone labor utilization, apprenticeship or on-the-job training (OJT) programs, skills training programs, etc. Promise Zone info can be found at the Promise Zone link.

SECTION E—PRICING

The Proposer must address all Pricing section items and provide, in sequence, the information and documentation as required. The Proposer must submit a completed Pricing Form as provided in Exhibit “P.”

E1. Submit a Fee schedule in accordance with the table provided Price and Fee Proposal Form, Exhibit” P.”

  1. Pre-Construction Services: Submit a not-to-exceed (NTE) cost for design and preconstruction services based upon the basis of design documents, resource loaded staffing plan and the proposed management plan for pre-construction services. Include all insurance, fees and bond cost. This scope shall include Construction Administration services to the fullest level. Estimated labor costs shall align with staff labor rate schedule and total hours in accordance with the Resource Loaded Staffing Plan as described in paragraph B1.c above.
  2. Construction Phase—Management Cost: Submit a NTE cost for Design–Builder management services in accordance with the Respondent’s staffing plan as described in paragraph B1 above and in accordance with the Respondent’s overall and comprehensive plan. Breakdowns are to be in accordance with all packages of CGMPs, as required to complete the Contract and conceptual schedule as described in the RFP and Contract Documents.
  3. Allowances: Allowances are as broken down on sheet included in Exhibit “P.” This is included as a NTE amount on the Price and Fee Proposal Form.
  4. Contingency: Contingency as included in Exhibit “P.” This is included as a NTE amount on the Price and Fee Proposal Form.

  1. Design–Builder’s Fee: Submit the Design–Builder fee in a percent cost format in Exhibit “P.” The “Design–Builder Fee” shall mean the full amount of compensation, both direct and indirect, (including without limitation all overhead and profit), to be paid to the Design–Builder for its own Work and the Work of all Subcontractors, for all costs and expenses, including warranty work. The Design–Builder’s overhead includes the indirect costs or fixed expenses of the operating business, (that is, the cost not directly related to the construction of the project, the, manufacture of a product or providing a service) that range from home office overhead, general and administrative costs, rent, utilities, employee bonuses, deferred compensation, estimating, project development, marketing costs, and other such cost. Overhead refers to all other labor and non-labor expenses required to operate the Design– Builder’s business.
  2. Insurance Cost: Submit cost as a percentage of Cost of Work. Include costs for insurance not covered in the Pre-Construction services fee above and insurance costs not covered in the MNAA OCIP [owner-controlled insurance program program].
  3. Subcontractor Default Insurance: Submit as a percentage of Cost of Work. Include cost to provide for subcontractor default insurance; if this should be the Design–Builder’s chosen method to increase small, minority and woman-owned business participation.
  4. Performance and Payment Bond: Submit as a percent of Cost of Work. Include cost to provide 100% performance and payment bond.
  5. Overhead Costs: In addition to the overhead costs as described in E1.a and E1.b above, the following overhead expenses are to be included as part of E1.a (Pre-Construction Services) and/or E1.b (Construction Phase—Management Cost) NTE pricing of the Contract cost: vehicles customary for construction services; personal protective equipment; contractor communications devices including mobile phones and radios; field office cleaning and waste management; sanitary facilities; security alarms; copy machines, scanners, plotter(s); field office’s supplies and postage and shipping; project documentation and reproduction and miscellaneous small tools are allowed.

*Financial Responsibility and SMWBE Participation will be evaluated and scored by the Chief Financial Officer, or his/her designee, and by the Director of Business Diversity Development, or his/her designee, respectively. Their scoring will be provided to and included in each Evaluation Panel Member’s scoring.

**The Owner’s consultants will review with the evaluation team to provide subject matter expertise on various aspects of the Proposals.

ADDITIONAL INFORMATION: Short-listed firms will be required to submit a Rough Order of Magnitude [ROM] Opinion of Probable Cost in accordance with the estimate format provided in Division 1 Specification Section 01 24 14 Design to Budget. Provide a Rough Order of Magnitude Opinion of Probable Cost in accordance with the basis of design documents and in accordance with the Respondent’s approach to the project. Proposers Rough Order of Magnitude Opinion of Probable Cost, if selected, will become the contractual design to budget amount. Short-listed Proposers ROM estimate will be an evaluation criteria for the interview process.
